UK Court Allowed For A Lawsuit To Be Delivered Via NFT

A UK Court allowed for a lawsuit to be delivered via NFT while the Civil Procedure Rules already allowed for lawsuits to be served using Instagram and Facebook in the past so let’s read more today in our latest crypto news today.

According to the notice from UK Law company Giambrone and Partners, a case brought by Fabrizio D’Aloia against Binance, Gate.io, OKX, Poloniex, and Bigkub over allegations that someone was operating a fraudulent clone brokerage resulted in a legal precedent offering a digital solution to serving someone. The judge on the case allowed parties to be served by airdropping NFTs onto wallets held by D’Aloia but then stolen by unnamed individuals. Until now, the Civil procedure Rules in the UK court allowed for lawsuits to be served by personal services, mail, or by means of fax but using electronic methods to serve someone often was the case where parties agreed in advance to such delivery.

According to Giambrone and Partners, the methods included Instagram direct messages and Facebook messages. The law firm noted:

“This order is a noteworthy development in the area of service of court documents and a welcome example of a court embracing new technology. This judgment paves the way for other victims of crypto asset fraud to pursue persons unknown who have misappropriated their cryptocurrency in situations where they otherwise would not be able to.”

An associate at the law firm, Demetri Bezaintes added:

“I am confident that this latest judgment using NFT service has the potential to show the way to digital service over the blockchain, with all the benefits of immutability and authentication, becoming the usual practice in the future on legal matters related to the digital world […] It is clear that this method of service has a far greater level of success over conventional means of service, such as post, in this sector.”

In addition to the precedent, the court also said that crypto exchanges were responsible for ensuring the stolen assets were not moved or withdrawn. A judge in the UK authorized a party in the Lawsuit to serve legal documents by using NFTs. The law company in the US also served a defendant using an NFT in an $8 million hacking case that involved Lichtenstein-based exchange LCX and the legal team airdropped the NFT as a temporary restraining order into the hot wallet.
